SINGAPORE: A nyonya kueh chain in Singapore has been embroiled in a legal tussle with American sandwich chain Subway.
The
owner of the sandwich chain, Florida-based Doctor's Associates, is
suing the owner of Singapore company Subway Niche for trade mark
infringement.
The hearing started on Tuesday.
According
to Subway's website, which has been selling sandwiches since 1965, it is
the world's largest fastfood chain with 35,383 stores in 98 countries.
There
are five Subway Niche outlets in Singapore - the first of which was
opened in 1987 in the basement of Wisma Atria - which sell local
favourites such as nyonya kueh, nasi lemak, mee siam and mee rebus. It
also sells sandwiches, cakes and pastries.
On October 29, 2007,
the owner of Subway Niche received a "cease and desist" letter from
Subway alleging that the former had infringed on its trademark rights.
About a year later, the case went to court but it was subsequently
dismissed.
In May last year, the American sandwich chain
recommenced legal proceedings against Subway Niche. The hearing
continues on Wednesday. - TODAY

I don't notice the logo until one day I notice they are selling different food and that Subway is a foreign establishment.
That's what the real Subway doesn't want, for people to be misled into thinking its part of theirs, hence they are taking legal action. You just proved their point.
Yeayea~ I think London Public transport council will have to sue Doctor's Associate for infringing their 'trademark' too.

they are one and same company and wholly owned by Temasek Holdings..such retention could be due to their well established reputation in the security services and armed police market....
As for CISCO systems....which is an american telco and networking org....they are selling technology and belong to entirely different industry ...
anyway coming back to subway name....haiz....so many memorable names can use ...but choose this one....

legally Subway cant sue Subway Niche.its dealing with food no doubt but logo isnt there and name also isnt exact.in most cases,there is no case from the start.

under the context of subway in the dictionary.that name or word cant be patented as in aeroplane word or bedroom word.
and subway niche company name isnt subway company.i understand if its delifrance then a company named delifrance niche can be sued because delifrance is itself a unique word not found in the english dictionary.
subway can sue and subway niche can countersue.
