Will these business logos misled you?

  Hi all,

  I am doing a case on trade mark issue and I need a little opinion from fellow forumnites to further support the case.

   

  Please look at the two business logos below:

  Business A's Logo

  

   

  Business B's logo

  

   Imagine if you are a frequent customer of A, dessert shop situated at Far East Plaza and one day when you visit Ion Orchard you bump into a dessert shop with logo B. Will you be misled to think that both shops are owned by the same owner and give and walk in to order the food without a second thought? Please discuss on how similar are both of the logos.

  All your comments and opinions are appreciated. Thanks in advance. =)

  If I am a frequent customer of A, I will think B is an imitation and not the same shop.

  hi,

  regarding this case yes i would be misled to think that both are under the same owner because as you can see in company B's logo its clearly just company A's logo but flipped around although there are slight differences. however many customers do not take much into consideration the logo as company A is already probably established, and will not bother to check as many customers just want to purchase their items and leave so there is a high chance that the customer will be misled.

  however there are cases where unless the customer knows that company A has only chains in certain areas. unless it was a coincidence that both company A and company B set up a shop at the same shopping mall.

  Definitely both share same logos with same color and shape.

  If I were a frequent buyer from Shop A, I would definitely have some doubts about this new shop because I was not informed of a newly opened branch. But majority of the people would not have noticed about the fine details like how the swirls swirl (clock-wise,anti-clockwise) nor the jagged lines. and I think there's a rule saying that the two brand logos cannot be too similar?

  but the orientation of logo 2 is different. it is an upside-down version of logo 1

  if u talking about real life fight case in court hor, Business B have no case. Blatant copy and paste, just change a bit here and there only.
