Man in the middle: Kakuta gets advice from Chelsea boss Carlo Ancelotti
Chelsea have asked for a suspension of FIFA's transfer ban which could allow them to sign players during the January transfer window.
The Blues have lodged an appeal against FIFA's ban, which prevents them from registering any new players during the next two transfer windows, with the Court of Arbitration for Sport (CAS).
And the CAS have now confirmed that Chelsea have asked for FIFA's ruling to be suspended until the outcome of the appeal is known.
A statement on the official CAS website read: 'Chelsea Football Club and Gael Kakuta have filed appeals at the Court of Arbitration for Sport against the decision issued by the FIFA Dispute Resolution Chamber on 27 August 2009.
'Both Chelsea FC and Kakuta have requested that the FIFA decision be stayed pending the outcome of the CAS arbitration. A decision concerning the request for a stay is likely to be issued by the CAS at the beginning of November.'
Chelsea were banned from signing any new players until 2011 after being found guilty of inducing Kakuta to breach his contract with Lens two years ago.
Kakuta, who was also banned from playing for four months, is also appealing against FIFA's punishment.
Chelsea have so far declined to comment.

Chelsea No2 Ray Wilkins has confirmed they plan to buy in January - if they can get their transfer ban overturned.
Wilkins was sitting in for the Stamford Bridge boss who was home in Italy to see his sick father yesterday.
And he said: "We are naturally concerned about the quality of the players we will be losing to the African Nations Cup in January.
"Any team in the country would miss four players of the calibre of Drogba, Essien, Kalou and Mikel.
"It would be very pleasant to be allowed to bring people in during January - and there are certainly a few names out there that Carlo would like to sign. We are going to lose some massively important footballers but until our appeal against the transfer ban is resolved we've no idea what the situation will be in January.
"We knew the African Nations Cup was coming and I'm sure Mr Abramovich has looked and thought 'We need a few more'. Although we are currently banned from making any signings, we are still looking and monitoring certain players.
"We're the same as any other team. We are always looking to strengthen our squad. If we are able to sign players in the New Year, all well and good. If the ban is not lifted, we'll just have to deal with it and crack on with what we already have."
